This Privacy Policy describes BARC India's policy on the collection, use and disclosure of information about you in connection with your use of BARC India's mobile application ("Application") (more specifically for Android users/ downloads), including emails and newsletters sent by BARC India to you.
"BARC INDIA" refers to Broadcast Audience Research Council a company duly existing and incorporated under the Companies Act, 1956, having its registered office at Rose Cottage, 61, Dr. SS Rao Road, Parel East, Mumbai - 400 012.

Please read the following statement to learn about our information gathering and dissemination practices.


Our privacy policy is subject to change at any time without notice. To make sure you are aware of any changes, please review this policy periodically.
By using this Application you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree please do not use or access our Application.
By downloading and using the Application, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy.

Please note that this Application is available freely for both our subscribers as well as non-subscribers. We share only weekly data templates, which we also publish on our website, with non-subscribers. However, we provide additional information, such as last week gain/loss, 'My Page' option etc., to our subscribers.

1. Collection of Personally Identifiable Information and other Information

When you subscribe, to and use our Application, you generally provide us with your name, email address, age, user name, password and other registration information ("Personal Information"). We collect and store your Personal Information which is provided by you from time to time. Our primary goal in doing so is to provide you with a safe, efficient, smooth and customized experience. This allows us to provide services and features that most likely meet your needs, and to improve our Application so as to make your experience safer and easier.

When you download the Application we collect device related information pertaining to your mobile phone including, but not limited to, the type of mobile device you use, your mobile device's unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use ("Automatically Collected Information"), irrespective of whether you subscribe on the Application. Once you give us your personal information, you are not anonymous to us.

We may automatically track certain information about you based upon your usage of our Application. We use this information to do research on our users' demographics, interests, and behaviour to better understand, protect and serve our users. This information is compiled and analyzed on an aggregated basis. This information may include the channels and programmes you have viewed on the Application, your mobile phone information, and your IP address. We collect data about your usage on the Application to help analyse our page flow, measure promotional effectiveness. The analysis of this data can also help us provide information that is targeted to your interests.

If you choose to post messages on our message boards, chat rooms or other message areas or leave feedback, we will collect that information you provide to us. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law. If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Application, we may collect such information into a file specific to you.

By virtue of you downloading the Application, we are provided with a unique advertising identifier for advertising and user analytics purposes. We may use the advertising identifier and/or a BARC INDIA unique identifier in connection with the information collected in accordance with the terms of this Privacy Policy. This Privacy Policy governs use of all data collected by us irrespective of whether any third party/platform has amended its policies from time to time including any periodical control by such third parties on collection of data on your preference.

2. Use of Demographic / Profile Data / Your Information :

We use personal information to provide the data you request. To the extent we use your personal information to market to you, we will provide you the ability to opt-out of such uses. We use your Personal Information to resolve disputes, troubleshoot problems, help promote a safe service, measure consumer interest in specific programmes and channels, inform you about online and offline offers, products, services, and updates, customize your experience, detect and protect us against error, fraud and other criminal activity, enforce our terms and conditions, and as otherwise described to you at the time of collection.

In our efforts to continually improve our product and service offerings, we collect and analyse demographic and profile data about our users' activity on our Application. We identify and use your IP address to help diagnose problems with our server, and to administer our Application. Your IP address is also used to help identify you and to gather broad demographic information.

We will occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like pin code, age, or income level). We use this data to tailor your experience of our Application, providing you with content that we think you might be interested in and to display content according to your preferences.

3. Sharing of personal information :

We may share personal information with our other corporate entities and affiliates/ business affiliates to help detect and prevent identity theft, fraud and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of our services; and to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity.

We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public. We and our affiliates will share / sell some or all of your personal information with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or re- organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this Privacy Policy with respect to your personal information.

We may need to contact you to comply or co-operate with a legal request. For this purpose, we shall use the email address provided to us by you. All communications sent by us at such email address shall be deemed to have been communicated to you.

Please note that some of this information is automatically collected without you voluntarily choosing to provide this information to us.

Cookies: When you download/register/use our Application, we may place cookies on your mobile device to recognize you. We do this to store your preferences, collect statistical data and track your use of our Application. Cookies are widely used, and most web browsers are configured initially to accept cookies automatically. If you prefer not to accept cookies, you may adjust and configure your browser settings accordingly. However, if you turn off cookies, or refuse to accept a request to place a cookie, some features and services on the Application may not be available and/or function properly.

4. Links to Other Sites :

This Service may provide web links to third party websites/applications/advertisements. However, this Privacy Policy does not apply to any information/data you may provide while visiting such third party websites/applications/advertisements. We encourage you to carefully read the privacy policies on those third party websites/applications/advertisements, before providing any of your personal/sensitive information.

5. Security Precautions

The security of your personal information is important to us at BARC INDIA. Hence, we follow industry accepted standards to protect your sensitive personal information.

Our Application has stringent security measures in place to protect the loss, misuse, and alteration of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession we adhere to strict security guidelines, protecting it against unauthorized access. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we try our best to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We assume no liability for any disclosure of data due to errors in transmission, unauthorized third party access or other acts of third parties, or other acts or omissions.

6. Choice/Opt-Out :

Subject to our policy regarding collection of data under any BARC INDIA identifier we provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account. You can stop all collection of information by the Application easily by uninstalling the Application. We will remove all your information, data, preferences, account details etc. from the Application, but we may retain information/data about you for the purposes authorized under this Privacy Policy, unless prohibited by law. For example, we may retain information to prevent, investigate, or identify possible wrongdoing in connection with the Application or to comply with legal obligations.

You may use the standard uninstall processes as may be available as part of your mobile device or via the Application.

If you want to remove your contact information from all BARC INDIA lists and newsletters, please visit unsubscribe option contained in such newsletters.

7. Advertisements on BARC INDIA

We may use third-party advertising companies to serve ads when you use our Application. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other Applications or websites in order to provide advertisements about goods and services of interest to you.

Information pertaining to you collected by the Application Platform will be governed by such platform's policies which are not under our control.

8. Data Retention Policy, Managing Your Information

We will retain User provided data for as long as you use the Application and for a reasonable time thereafter. If you'd like us to delete your information that you have provided via the Application, please contact us and we will respond within a reasonable period of time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

9. Your Consent :

By using the Application and/ or by providing your information, you consent to the collection and use of the information you disclose on the Application in accordance with this Privacy Policy, including but not limited to your consent for sharing your information as per this Privacy Policy.

10. Children :

Our Application is not intended for use by children under the age of thirteen (13). We do not knowingly allow children under the age of thirteen (13) to register for any service, and we do not knowingly collect any personally identifiable information from children under the age of thirteen (13). If you become aware that a child has provided us with personal information without parental consent, please contact us. If we become aware that a child under thirteen (13) has provided us with personal information without parental consent, we take steps to remove such information and terminate the child's account.

11. Device permissions currently used :

Please find below a list of permissions requested by the latest version of BARC Application (related to Android downloads).

  • Approximate and precise locations (android.permission.ACCESS_COARSE_LOCATION, android.permission.ACCESS_FINE_LOCATION)
    Purpose : These permissions are used to capture user's exact location while user is performing login to the system.
  • Full network access (android.permission.INTERNET)
    Purpose: This is used for communicating over HTTP protocol with back end server.
  • View network connections (android.permission.ACCESS_NETWORK_STATE)
    Purpose: Allows the app adjust its behavior based on network connectivity.
  • Keeping the device awake (android.permission.WAKE_LOCK)
    Purpose : This permission allows application to keep device awake while it is performing backend server communications.
  • Access to external storage (android.permission.READ_EXTERNAL_STORAGE, android.permission.WRITE_EXTERNAL_STORAGE)
    Purpose: This permission is required by google play services to store and read cached data.
  • Write to internal storage (android.permission.WRITE_INTERNAL_STORAGE)
    Purpose : This permission is used by application to store downloaded files like newsletters to storage.
12. Types of data collected

The Application also uses Google Analytics to collect and report the following metrics, without limitation:
a) Opening of various activities
b) Manual location refresh attempts
c) Failures in the context of the app, such as inability to submit feedback due to lack of network connectivity.

These metrics are viewed in aggregate through Google Analytics. In accordance with Google Analytics policy, metrics shall not include personally-identifiable information.

14. Severability

If any of the terms contained herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforce-ability of any remaining terms.

15. Governing Law and Jurisdiction :

By downloading/registering/using this Application, you agree that this Application is created and controlled by BARC INDIA.
This Privacy Policy shall be governed by and shall be construed in accordance with the laws of India.
Courts in Mumbai shall have jurisdiction in respect of all the terms, conditions and disclaimers contained in this Privacy Policy.

Any changes to this Privacy Policy shall be effective upon posting, and your continued use of the Application after we make any such changes constitutes your binding acceptance of those changes.
